Upon your acceptance of this EULA and fulfillment of applicable payment obligations, Pawn Software grants you a limited, non-exclusive, non-transferable license to access and use PawnSmarts under one of the following types:
This license is a license to use the Software as a tool. All other responsibilities remain with you.
Permitted: Use by the Licensee, their employees, and business partners within their pawn business. Use across multiple devices. Use at the number of locations specified in your purchase agreement.
Not permitted: Transfer (except as in Section 6), sub-licensing, reselling, use as a service bureau for other businesses, or use in California, Massachusetts, or Texas.
"Lifetime" means the operational life of the PawnSmarts product — not the biological lifetime of the Licensee. The Company will maintain the Software in good faith but makes no commitment to maintain it indefinitely.
Full access to all features at time of purchase, all software updates and new features during the product's active life, security patches and bug fixes.
Dedicated support (available separately), additional locations beyond those confirmed at purchase, any future product designated as a distinct successor platform.
Lifetime License pricing is individually determined based on number of locations, onboarding requirements, and support needs. The Company sets prices at its sole discretion.
Non-refundable once access is granted, except as required by Texas law.
If the Company discontinues PawnSmarts, Lifetime License holders receive at least 180 days advance notice and a full data export opportunity. No monetary refund is provided.
By accepting this EULA, you acknowledge that: PawnSmarts is a tool, not a compliance service; you are solely responsible for verifying the accuracy of all data entered; you are solely responsible for reviewing all reports before submission; and you are solely responsible for confirming that submissions were received by the intended recipient.
A Lifetime License belongs to the individual account holder — not to any business entity. It is a personal right.
If the Licensee sells or transfers their pawn business, the license remains with the original Licensee. The incoming owner must purchase their own license. Historical data may be exported at the Licensee's discretion, but the license does not transfer.
Upon verified death, the license may transfer one time to an immediate family member (spouse, child, parent, or sibling) continuing the same business. Request in writing to [email protected].
Departing employees and partners must be removed from the account. They must obtain their own license for any new pawn operation.
The software is provided "as is" without any warranty of any kind. The Company expressly disclaims all warranties, including merchantability, fitness for a particular purpose, regulatory compliance, accuracy of report output, data integrity, uninterrupted access, and freedom from error. You assume all risk.
The Company's liability under this EULA is subject to and limited by the Limitation of Liability provisions in the Terms of Service, which are incorporated herein by reference.
This EULA is governed by the laws of Texas. Disputes are subject to the arbitration provision in the Terms of Service.
